Franchising code of conduct
The Franchising Code of Conduct sets rules for how franchisors and franchisees work together.
Legislation
The Code is a regulation authorised under the Competition and Consumer Act 2010 (Act).
All franchisors and franchisees must follow the Code.

Recent reforms
Dr Michael Schaper independently reviewed the Code in 2023.
Dr Schaper made 23 recommendations. The Minister for Small Business released the government’s response in May 2024. The government agreed or agreed in principle with all recommendations.
The Code was remade in line with the government’s response.
The new Code came into effect on 1 April 2025.

Franchising Disclosure Register
Treasury hosts and administers the Franchise Disclosure Register.
The register:
- increases franchisor transparency and access to disclosure information
- helps franchise buyers make an informed decision before entering a franchise agreement.

Franchise support
There is dedicated support for the franchise sector.
Australian Small Business and Family Enterprise Ombudsman
The Australian Small Business and Family Enterprise Ombudsman (ASBFEO) is part of Treasury’s portfolio.
The ASBFEO:
- helps small businesses and family enterprises in dispute with other businesses or Commonwealth Government agencies
- advocates for small businesses and family enterprise interests concerning relevant legislation, policies and practices
- provides support to the franchising sector when disputes arise, including by helping with compulsory mediation provisions in the Franchising Code of Conduct.

Australian Competition and Consumer Commission
The Australian Competition and Consumer Commission (ACCC) is the independent regulator of the Franchising Code.
You can report business practices and behaviours that concern you to the ACCC.
